Centre of Expertise Global and Inclusive Learning
This research project, conducted within the Multilevel Regulation research group at the Centre of Expertise Global & Inclusive Learning, focuses on the impact of new EU regulations on dispute resolution within online platforms. The Platform-to-Business (P2B) Regulation and the Digital Services Act (DSA) require platforms such as Meta, Amazon, and eBay to develop internal dispute resolution mechanisms or engage external mediators. These mechanisms play a crucial role in resolving disputes related to content moderation, terms and conditions, and data processing.
Objective
The project aims to provide insights into the development of dispute resolution markets and mediation practices in the Netherlands and the EU. It examines how these new regulatory obligations affect both businesses and individual users, and it highlights the implications for professional groups such as mediators. Furthermore, the research enhances users' understanding of the available mechanisms to challenge platform decisions.
The research
Dispute resolution and mediation markets are undergoing significant changes due to the P2B Regulation and the DSA. These new regulations directly impact users and businesses in the Netherlands and the EU by requiring platforms to offer more accessible and transparent dispute mechanisms. Mediators and other professionals are also challenged to adapt to this new digital dispute landscape, responding to the growing need for specialized knowledge of digital platforms and their legal frameworks.
Online platforms not only shape e-commerce but also affect fundamental rights, such as freedom of expression. Decisions regarding content moderation and data management have direct consequences for users.
